A study of the lineage
of children resulting from modern fertility from the perspective of Imamieh
jurisprudence and Iranian law
Abstract
New fertility, or
artificial insemination, is a therapeutic approach developed in the late
twentieth century to treat infertility in couples. The first on fish began
in 1765 and eventually led to the treatment of infertility in humans. What is new about children born of new methods of reproduction is
the challenge and the question of who such children join in terms of lineage
and who are their parents? Owners of ovum’s and sperm or recipient couples? The present study is a
descriptive-analytical study with the aim of examining the views of Imamieh
jurisprudence and Iranian law on the lineage of children from modern fertility. And the method of collecting information is library and taking
notes from available resources. In the process of research, we achieved a number
of results, including that these types of children are related to the owners of
sperm and ovum’s in terms of lineage and have a legal lineage and relative
relationship with them.
